Introduction

Abdi & Associates, Inc. (“we,” “us” or “our”) respects your privacy. This Privacy Policy explains what personal information we collect when you visit abdilawfirm.com (the “Site”), contact us, or become a client, how we use it, with whom we share it, and the choices you have. 1. What information we collect

Information you give us. When you call, email, text, or submit a form on the Site, we collect the information you choose to provide, such as your name, phone number, email address, mailing address, the language you prefer, and a description of your legal issue, which may include information about an injury, a medical condition, your employment, or a benefits claim. If you become a client, we collect the information needed to represent you, which may include medical, employment, financial and government records.

Information collected automatically. When you visit the Site, our hosting provider, analytics tools and security services automatically collect device and usage information, such as your IP address, browser and device type, operating system, referring pages, the pages you view and when, and approximate location derived from your IP address. This information is collected through server logs, cookies and similar technologies, and is used to operate, secure and improve the Site.

Information from other sources. In representing clients we obtain records from third parties as authorized by the client or by law, such as medical providers, employers, insurers and government agencies. We may also receive limited information from advertising and analytics providers about how visitors reach the Site.

We do not collect passwords or payment card information through the Site. The Site has no user accounts, forums or contests.

2. How we use your information

  • to respond to your inquiry, schedule a consultation, and evaluate whether we can help with your matter;
  • to provide legal services to clients and communicate about their matters;
  • to send text messages you have consented to receive (see Section 4);
  • to operate, secure, analyze and improve the Site, and to prevent fraud and abuse;
  • to comply with legal, regulatory and professional obligations, including record-keeping requirements that apply to lawyers;
  • to enforce our Terms of Use and protect our rights.

We do not sell your personal information, and we do not use inquiry or client information for advertising to other people.

3. When we share information

We share personal information only as needed for the purposes above: with service providers that help us operate the Site and our practice, such as web hosting, form and intake tools, email, telephone and text messaging platforms, e-signature, case management software, and analytics and security services, each of which is permitted to use the information only to provide services to us; with co-counsel, experts, medical providers, insurers, courts, agencies and opposing parties as necessary to represent a client and as authorized by the client; and when required by law, subpoena or court order, or to protect the safety, rights or property of any person. We may share information in connection with a merger, sale or reorganization of the firm, subject to the professional rules governing client files.

4. Text messaging (SMS)

If you provide your mobile number and check the SMS consent box on a Site form, we may send you text messages related to your inquiry or matter, such as consultation reminders, requests for information, and case updates. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out and HELP for help. Information obtained as part of the SMS consent process, including your phone number and consent, will not be shared with or sold to any third party for their marketing purposes.

5. Cookies and analytics

The Site uses cookies and similar technologies, including analytics tools and Google reCAPTCHA, to understand how the Site is used, to remember your language preference, and to protect our forms from spam. You can set your browser to refuse cookies or to alert you when a cookie is being set; some features of the Site may not work properly without them. The Site does not currently respond to “Do Not Track” browser signals, but it honors opt-out preference signals where required by California law.

6. How long we keep information

We keep inquiry information for as long as needed to respond to the inquiry, evaluate a potential conflict of interest, and comply with our professional obligations. Client files are retained for the period required by California law and State Bar guidance and by our engagement agreement, and are then securely destroyed or returned to the client. Website log and analytics data is kept for the retention period set by the relevant service provider.

7. How we protect information

We use reasonable administrative, technical and physical safeguards to protect personal information, including secure hosting, encrypted connections to the Site, access controls and secure electronic signature tools. No method of transmission over the Internet is completely secure, so we cannot guarantee absolute security. Do not send highly sensitive information, such as a Social Security number, through a Site form; we will arrange a secure method when it is needed for your matter.

8. Children

The Site is not directed to children under 18, and we do not knowingly collect personal information from children through the Site. If you believe a child has provided us information, contact us and we will delete it. When we represent a minor in a legal matter, we collect information from the parent or guardian as needed for the representation.

9. Your privacy rights

You may contact us at any time to ask what personal information we hold about you, to request a correction, to request deletion, or to opt out of marketing communications. We will respond as required by applicable law. Some information cannot be deleted while a matter is open or while we are required to retain it by law or professional rules. You may opt out of text messages by replying STOP and out of marketing email by using the unsubscribe link or contacting us.

10. California residents

California residents may have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including the right to know what personal information a business collects, uses and discloses, the right to delete and correct it, the right to opt out of the sale or sharing of personal information, the right to limit the use of sensitive personal information, and the right not to be discriminated against for exercising these rights. Some of these rights apply only to businesses that meet the statute’s thresholds, and information collected in the course of providing legal services is subject to the attorney-client privilege and other legal exceptions. We do not sell or share personal information for cross-context behavioral advertising. California Civil Code section 1798.83 also permits California residents to request information about disclosure of personal information to third parties for their direct marketing purposes; we do not make such disclosures.

11. Changes to this policy

We may update this Privacy Policy from time to time. The revised version will be posted on the Site with a new “Last updated” date. Material changes will be indicated by a notice on the Site.

12. reCAPTCHA and Google

The Site is protected by reCAPTCHA, and the Google Privacy Policy and Terms of Service apply to its use.
